CHICO, Calif. -

The man accused of killing a pastor at a Butte County Highway intersection could receive the death penalty.

Butte County District Attorney Mike Ramsey confirmed that prosecutors are seeking the death penalty against the alleged shooter Jeffrey Menzies.

Menzies is charged with shooting 26-year-old Pastor David Yang in September 2011. Investigators said he shot Yang from an open field on the corner of Bruce Road and Highway 32 in Chico.

Ramsey said the defense is "dragging their feet," because they asked the judge to push back the trial to next July. The prosecution wants the trial to start before February because a key witness is set to deploy overseas early next year.

Menzies is due back in court on November 7th to reset his trial date.
