Man Receives Sentence for Child Endangerment; Daughter Paralyzed From DUI Crash

COTTONWOOD, Calif. -

A Shasta County man convicted of child endangerment has been sentenced to four years probation.

Nicholaas Myrtle took plea deal on Monday, adding the four years to a year in jail that he had already served.

Myrtle crashed on Gas Point Road in Cottonwood in 2012 with his children in the car.

His three-year-old daughter was paralyzed from the waist down and his four-year-old was seriously injured.

Investigators said he was under the influence of prescription drugs and medical marijuana while driving.

Myrtle was convicted of child endangerment in September but the jury was hung on the two other charges: driving under the influence, and a second child endangerment count.

Instead of a re-trial, Myrtle settled by pleading guilty to a second child endangerment count last month. He was also charged with a misdemeanor D.U.I. charge.

Deputy District Attorney Toby Powell said it was a difficult decision.

"We don't want to send the wrong message to the community that its okay to get in your car and under the influence and put your children at risk," Powell said.

"It really is a case where this defendant, Mr. Myrtle, has kind of suffered the worst possible thing he could do – for the rest of his life to know that he put his daughter in a wheel chair," Powell said.
