Man pleads no contest to assaulting Shasta College football player Tyler Burton

CHICO, Calif. -

The man charged with assaulting Shasta College football player Tyler Burton in Chico last October plead no contest to felony assault with great bodily injury on Tuesday.

Andres Rodriguez's attorney wanted to make sure that Burton was in stable condition before making the plea. He also said that Rodriguez had fully intended on taking responsibility for the crime.

"I did not want to plead my client until I was sure as much I could be that the victim has reached a point that is life is no longer in danger," said Rodriguez's attorney Phillip Heithecker.  "He's stable.  He's been hurt tragically but he's out of harms way in terms of death and I couldn't plead my client until I was sure of that."

Tyler Burton, 21, was punched while at a party in Chico and hit his head on the ground, leaving him in critical condition. After being taken off of life support, Burton slowly started to recover from his life-threatening head injury.

Rodriguez will be sentenced on August 20 at 9:30 a.m. No bail was set but he could face up to four years in state prison and a $27,000 fine.
