OROVILLE, Calif. -

A judge has suspended all criminal proceedings for a Butte County man accused of shooting three members of his family in Paradise, killing one of them.

63-year-old Robert McClintock was arrested on Labor Day after investigators say he shot his brother and niece and killed her mother in their home.

The defense said McClintock has not been cooperating with his attorney and investigators.  Judge James Reilly ruled that all criminal proceedings are suspended until McClintock is evaluated by a psychologist.

McClintock will be evaluated for five weeks and a report is due back in court on October 16.
