Deputy accused of beating unconscious man, threatening witness

CHICO, Calif. -

One week ago, 31-year-old Yuba County Sheriff's Deputy Nelson Magana, who just four years ago was named Yuba County's Peace Officer of the Year, was off duty in Downtown Chico to celebrate Saint Patrick's Day. 

According to an employee at Burgers and Brew on Broadway an intoxicated Magana got into a fight with a 30-year-old Chico man over a pair of sunglasses, chasing him through the restaurant and down a stairwell, where he's accused of beating up a man who was unconscious.

"What's concerning is the beating of an unconscious person. We don't have the victim's medical records in yet, so we're not sure what any lasting consequences may be," Butte County District Attorney Mike Ramsey.

The alleged beating ended when patrons stepped in to stop it.

Magana is also accused of threatening a witness who was calling 911 to report the incident.

"The allegation is that the witness heard the deputy yell at him 'You better not call police or I'll blank you up,'" Ramsey said.

Magana, who is on administrative leave, posted bail but will appear in court next month.  If convicted he faces up to seven years in prison.
