CITY OF SHASTA LAKE, Calif. -

A Shasta County Sheriff's deputy said he was attacked by a Shasta Lake man when he attempted to contact another person in the City of Shasta Lake.

Deputy Mike Nelson was trying to contact an individual on Morning Star Lane when another person, Rusty Toso, came out of his house and attempted to get into a fight with the deputy.

Deputy Nelson said he had to use pepper spray and baton strikes to get Toso under control. He also called for multiple back up units.

According to Sgt. Jason Barnhart, Toso did not know the person the deputy was initially trying to contact.

The first subject was released.

Sgt. Barnhart said they have dealt with Toso in the past, but he has usually been clear headed. He also said that Toso appeared to be intoxicated when he tried to attack the deputy.

Toso was transported to the hospital with some cuts on his arm.
