REDDING, Calif. -

A man is facing charges for firing a warning shot after an intruder broke into a marijuana garden.

Redding Police responded to the 1800 Block of Henry Avenue at 12:29 p.m. after neighbors reported hearing a gunshot.

There officers found 56-year-old Clint Cervenka, who told police he was in a marijuana garden in his backyard when a black male climbed over the fence into his yard, threatening him and demanding marijuana.

In defense, 25-year-old Dustin Burge, who was also working in the garden, got a pistol from inside the home and fired a warning shot into the air.

Witnesses say the intruder sped off in a white sedan being driven by a slender black woman. Both the man and woman are described as being around 25-years-old.

Police took the pistol, and arrested Burge for negligent discharge of a firearm within city limits.

Nobody was injured.
