Woman removes GPS monitor; faces severe consequences

A Chico woman is facing prison time after she was found guilty of slipping off her ankle monitor and leaving the home she was confined to.

Samantha Abernathy, 26, was sentenced to a three-year term for felony possession of a controlled substance in 2012. She was placed on alternative custody supervision at a clean and sober living house in Chico.

On March 1, Abernathy slipped off her G.P.S. ankle monitor and left the home for a few hours.

When she returned, deputies arrested her for felony escape.

Her attorney argued in court that it was not an escape because she returned, but the prosecution argued that it did not matter and that "the crime is completed the moment she leaves". The jury agreed.

Abernathy will now face up to five years in state prison when she is sentenced on August 6.
